The right of access to information

The right of access to information and re-use of information.



Article 3 of the Act on the Right of Access to Information (Official Gazette nos. 25/13, 85/15) regulates the right of access to information of natural and legal persons through openness and the public nature of the work of public authorities.

The right of access to information and the re-use of information entails the right of a user to request and receive information, as well as the obligation of the public authorities to provide access to the information requested and to publish information even if no particular request has been made when publication stems from their obligation prescribed by law or some other general regulation.

The right of access to information and the re-use of information is regulated and exercised in accordance with the Act on the Right of Access to Information (Official Gazette nos. 25/13, 85/15). This Act regulates the principles of the right of access and re-use of information, restrictions on the right of access and re-use of information, and the procedure of exercising the right of access to information and re-use of information and the protection thereof.

Information Commissioner

Omišalj Tourist Board informs the public through its official website by means of documents and information that it possesses, and which are available to the public in electronic form and can be accessed without making a special request. Access to all other information and documents is gained by submitting an oral or written request.

The right of access to information and the re-use of information is exercised by submitting a request to the Information Commissioner of Omišalj Tourist Board in one of the following ways:

Conditions of re-use of information

The public authority shall give the user information for re-use without restrictions, for free use, and in open format.

In justified cases, the public authority may stipulate the conditions for re-use. In the case of stipulating the conditions for re-use, their content and application may not unjustifiably restrict the possibilities of re-use, nor may they be used to restrict market competition.

The conditions for the re-use of information may not be discriminatory for the same or similar types of information, or for commercial or non-commercial use.

The public authority that re-uses its own information as the basis for commercial activities that do not fall within the scope of its public activities shall be subject to the same conditions that apply to other users.

The type and content of permits that stipulate the conditions of re-use, in line with standard open permits, shall be regulated in an ordinance issued by the minister responsible for administrative affairs.

The public authority is obligated to disclose the permits stipulating the conditions of re-use, or links to such permits, on its website, in accordance with the standard open permits.

Fees for access to information

Omišalj Tourist Board is entitled to a fee to cover the material expenses incurred in providing information to the user of the right of access to information and the re-use of information, as well as to cover the expenses of delivering the requested information. The fee is charged according to the criteria for setting the fee to cover the material expenses and the expenses of delivering the requested information (hereinafter: Criteria) as referred to in Article 19 paragraph 2 of the Act on the Right of Access to Information (Official Gazette nos. 25/13, 85/15).

The fee to cover material expenses will be set as follows:

    single A4 copy – HRK 0.25

    single A3 copy – HRK 0.50

    single A4 copy in colour – HRK 1.00

    single A3 copy in colour – HRK 1.60

    file on a single CD – HRK 4.00

   file on a single DVD – HRK 6.00

file on a memory stick depending on its capacity - HRK 210 for 64 GB, HRK 150 for 32 GB, HRK 120 for 16 GB, HRK 50 for 8 GB, HRK 30 for 4 GB.

    single page scan – HRK 0.80

    converting videotape, audiotape, or floppy disk records into an electronic file – HRK 1.00

The expenses for delivering information are charged according to the valid price list of regular postal services.

NOTE:

The fee to cover material expenses for services which are not stipulated by the Criteria will be determined by the public authority in such a way that it will include the average market price of the service, the capital allowance of the public authority and the cost of postal services. The delivery cost is calculated according to the valid price list of postal services. The user of the right to information must fully and in advance deposit the anticipated amount of material costs. If the user does not deposit the amount within the deadline, it will be considered that the user has withdrawn the request. Omišalj Tourist Board will issue an invoice to the user of the right to information according to the amount specified in the criteria.

Fees for the re-use of information

Omišalj Tourist Board shall charge no fees for the re-use of information if the same information is published on the official websites.


According to the criteria for setting the fee to cover material expenses and the expenses of delivering the requested information as referred to in Article 19 paragraph 2 of the Act on the Right of Access to Information (Official Gazette nos. 25/13, 85/15), Omišalj Tourist Board may charge the user for the material expenses for the re-use of information arising from its reproduction, provision and delivery if one of the following conditions is met:

the public authority is primarily financed from its own revenues; or

the user requests information by which the public authority secures adequate revenues to cover the costs of its collection, development, reproduction and publication;

the public authority determines the fee for the re-use of information, in line with objective, clear and verifiable criteria for the calculation of the costs of re-use of information, as laid down by a regulation of the Government of the Republic of Croatia. The costs are calculated in line with the accounting rules applied to the said public authority;

the total annual revenue of the public authority earned on the basis of the calculation of costs does not exceed the costs of the collection, development, reproduction and provision of information, including a reasonable rate of return on investment.
